These Terms and Conditions (the “Terms”) describe the rights and responsibilities of our customer(s) (“you”) and Denis Mahony Limited (“us”) in relation to your purchase of a vehicle through this website (the “Website”). Please read these Terms carefully as they represent a legally binding agreement between you and us (and the finance company if you purchase a vehicle on finance). Any purchase of a vehicle on this website is subject to these Terms.

Ordering your car online

On our website, you can search our range of new and used vehicles. Once you have made your choice, you can pay  a reservation fee for your car, or finance it by applying for a finance package online. There is also an option to reserve a car for up to 48 hours.

The prices displayed on our site are inclusive of VAT.

At the beginning of the order process, you will be asked to confirm your preferred payment method (Reservation Fee).

Once you have selected your preferred vehicle, you will then receive a quote based on your preferred payment method. You can also choose to review quotes for other payment methods.

If you decide to reserve a vehicle by paying a reservation fee, you will be asked to enter your personal and payment card details (see the ‘Paying a Reservation Fee’ section below).

Buying with Finance

If you decide to place an order and buy a vehicle on finance, you will be asked to enter your personal details and address, and then fill in a finance application online. You must be over 18 to apply for finance, and acceptance is subject to these Term and the finance provider’s terms and conditions.

When you click “submit application”, we send your information to our Finance Managers who will review your eligibility for the finance package requested. As part of this review, credit checks and searches will be carried out by potential lenders.

If your finance application has been successful, you will be contacted by a member of our sales team, but please note that this does not mean that your order has been accepted. Your order merely constitutes an offer to enter into your chosen finance package, subject to these Terms and the terms of the finance agreement. Even if your finance application is approved, there may be circumstances in which we are unable to accept your order. If this is the case, we will inform you of this. This might be because the vehicle has already been sold, because we have identified an error in the price or description of the vehicle or because we are unable to meet a delivery deadline you have specified.

If your application has not been successful, we will contact you offline verbally or in written form to notify you that your application has been declined.

We will be in touch with you by email or phone regarding the next steps required to complete your purchase. These steps will include signature of your finance agreement, payment of a deposit, and if applicable, arrangements regarding the part-exchange of your vehicle or other documentation required including identification requirements under the money laundering act.

Once we and the lender have confirmed acceptance of your offer, you will be sent an order confirmation by email.

At that point, a finance agreement will be formed between you and the lender for the finance and use of your new vehicle.

Paying a Reservation Fee

If you choose to reserve a car by paying a reservation fee, you will be asked to enter your personal details, address and payment card information. When you click on “submit payment”, the amount of the reservation fee will be debited from your payment card immediately.

After paying a reservation fee, you will receive an email from us that acknowledges receipt. Please note that this does not mean that your reservation has been accepted. All reservations are subject to acceptance by us, as we need to check that the car has not already been sold or reserved by someone else. We will confirm our acceptance of your reservation by sending you a confirmation email (the "Reservation Confirmation").

Your vehicle will be reserved for 48 Hours from the time the Reservation Confirmation is sent. We will be in contact with you to discuss the next steps required to complete your purchase.

If you decide not to purchase the vehicle, you can request a refund of the reservation fee at any time by contacting your sales executive at your preferred retail centre. Your payment will be refunded in full, usually within 5-10 days.

A fully refundable reservation fee (the “Reservation Fee”) is payable to secure a reservation of your chosen vehicle. If payment of the Reservation Fee is not made, your online reservation will automatically lapse.

Your debit or credit card payment (or other approved method of payment) of the reservation fee will be processed, and your Reservation Fee will held by us. You confirm that you are authorised to use the payment method that you provided to make the payment for the Reservation Fee and you accept that We, and/or your card issuer, may carry out security checks to confirm that this is the case.

Changes to your order

If you decide that you would like to make a change to your order after you have placed the order, please let us know as soon as possible by contacting us by phone and/or email. At our discretion we may present you with a new order proposal accommodating the changes. This proposal will take account of any resulting changes to your finance package and delivery/collection date. If you choose to accept the new proposal, your previous order will be cancelled. If you do not communicate your acceptance of the new proposal to us within the required timeframe, we will continue to fulfil your original order.

Please note that we cannot agree to all requests for changes to vehicles. We will contact you to discuss possible options in these circumstances, but we will be entitled at our discretion to hold you to your original order.

Your online reservation is not transferable or assignable. If we are unable to accept your online reservation for any reason, we will inform you of this and will not be liable to you or anyone else in those circumstances


If you have purchased your car on finance via a PCP agreement:

You will be asked to sign a WAIVER – Consumer Credit Act, 1995  -

This waiver means you are giving up your right to a 10 day period to reconsider your commitment to the agreement.

If you have purchased your car on finance via a HP agreement:

You will be asked to sign a WAIVER – Consumer Credit Act, 1995  -

This waiver means you are giving up your right to a 10 day period to reconsider your commitment to the agreement.


Collection and Delivery

During the online order process, you will be asked to choose how you would like to receive your vehicle. You will be given the following options:

- collection from the dealership where the car is currently located;

- collection from another dealership within the group; or

- delivery to your home address (which must be the same as the billing address for the card used to pay for the car, or the address on your finance agreements, as applicable).

Costs and lead-in times will be displayed for each option. These are estimated lead-in times only and we cannot promise to have the car ready within those timeframes. The actual collection or delivery date will be confirmed by email or telephone.

Delivery fees can be added to the vehicle price or paid for separately.


If you are unable to collect your vehicle from any of our retail centres, or should you prefer to have your vehicle delivered, we can arrange delivery of your new car direct to your home. Due to government guidance being updated regularly, please contact your preferred retail centre to discuss your delivery requirements.

We are a member of SIMI (Society of the Irish Motor Industry) in Ireland and we abide by all applicable SIMI Codes of Conduct.

Privacy policy

We will only collect personal information from you for the purpose of completing the purchase of your chosen vehicle.

Such personal information will only be shared with third parties in connection with the reservation and purchase of your chosen vehicle, including but not limited to Stripe Payments, Toyota Ireland, Lexus Ireland & Mercedes-Benz

We shall not be liable, whether in contract, tort, or otherwise, arising under or in connection with this agreement for any indirect or consequential loss.

Governing law and jurisdiction

These terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with or its subject matter or formation, shall be governed by, and construed in accordance with, the laws of Ireland.

Each party irrevocably agrees that the courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.


Each of the paragraphs of these terms operates separately.  If any court or relevant authority decided that any of them are unlawful, the remaining paragraphs will remain in full force.

We reserve the right to amend these terms and conditions at any time.  If we do this, we will publish the updated terms and conditions on the Website.
